Small Claims Court

The Small Claims Court of New Brunswick was established on January 1st, 1999. This court hears civil suits for debt or damages, return of personal property or a combination of those claims, where the value involved does not exceed CDN$6,000.00 (six thousand Canadian dollars).

The small claims lawsuit is heard by an adjudicator, (an experienced private practitioner appointed for a fixed term), not a judge.

The rules and procedures relating to the Small Claims Court were designed so that individuals can initiate or defend proceedings themselves and appear in court without a lawyer, if they so choose. Of course, litigants are still free to retain the services of a lawyer to initiate or defend proceedings and to appear in court on their behalf.
